This Agreement and Disclosure is the contract which covers rights and responsibilities for electronic funds transfer (EFT) services offered to you by Forest Park FCU. Electronic funds transfers are electronically initiated transfers of money through automated teller machines (ATMs), audio response services, personal computers, Forest Park FCU¹s eBranch, point-of-sale (POS) terminals, debit card purchases, preauthorized debits, direct deposits, automatic payment/deposits (ACH) involving your Credit Union Accounts.

In this Agreement and Disclosure, the words "you" and "yours" mean those who sign the application as applicants, joint owners or any authorized users. The words "we", "us" and "Credit Union" mean Forest Park FCU. The word "accounts" means any one or more of your Credit Union deposit accounts. By signing the Account Card or an ATM Card Application, or signing or using the ATM Card or other electronic funds transfer services, each of you, jointly and severally, agree to the terms and conditions in this Agreement and any amendments.

A. Services

  1. POS/Debit/VISA Check Card. If we approve your Application for a VISA/Check Card, you may use your Card to purchase goods and services at point of sale (POS) terminals designated by the Credit Union and anywhere participating merchants honor your Card. Card purchases will be covered by funds deducted from your Checking Account. If your account balance is insufficient to cover Card purchases, the Credit Union may treat these purchases as overdraft requests under your overdraft protection plan, or the Credit Union may terminate all services under this Agreement.

  2. ATMs. You may use your Card and Personal Identification Number (PIN) in automated teller machines and other terminals, machines or facilities as Credit Union may designate. You may use your Card to:
    1. Make deposits to, withdraw cash from or transfer funds between your Checking Account and your Savings Account.
    2. Transfer payments to or take advances on your Line of Credit loan. VISA advances may be taken in cash (up to the daily cash limit described below) and deposited into your Savings or Checking Accounts.
    3. Make balance inquiries about your Checking and Savings Accounts.


  3. Check Guarantee Card. The Credit Union guarantees payment of your drafts drawn on the Credit Union prior to the expiration date of this Card, provided your signature on the draft is verified, the first four digits of the card number and the expiration date of this Card are written on the draft and the draft is promptly deposited. You may cash drafts up to $100.00 at any Credit Union branch or with any Oregon merchant. If a draft validly guaranteed with this Card is dishonored, the draft must be delivered or mailed to the Credit Union for payment. By signing or using this Card, you agree to:
    1. Waive all rights to stop payment on drafts guaranteed with this Card;
    2. Notify Credit Union of any loss or unauthorized use of this Card;
    3. Pay Credit Union for any draft guaranteed with this Card, if funds in your account are insufficient, and
    4. Surrender this Card to Credit Union upon request.


  4. TeleTouch 24 Audio Response Unit. If we approve TeleTouch 24 ARU access service for your accounts, you may access your accounts through TeleTouch 24 with a four (4) digit access code. You must use your access code and account number to access your accounts. You may use TeleTouch 24 service to:
    1. Change your access code.
    2. Obtain account information related to any of your savings and loan accounts regarding current balance, checking history, savings dividends and rates, loan interest and payoff amounts, payroll and automatic deductions.
    3. Make transfers to or from Prime Share, Deposit, Transaction, Checking, or other Savings or such accounts you have authorized in writing prior to such transfer request.
    4. Request advances on your personal line of credit loan, deposit the proceeds in any of your accounts or have the proceeds mailed directly to you at the mailing address listed for your account.
    5. Withdraw funds from savings, checking and line of credit accounts by check made payable to you and mailed to you at your mailing address.
    6. Make loan payments from any savings or checking account to any loan account of yours.


  5. PC Banking (eBranch). If we approve eBranch access service for your accounts, you may access your accounts through eBranch with a four (4) digit access code. You must use your access code and account number to access your accounts. You may use eBranch service to:
    1. Change your access code.
    2. Obtain account information related to any of your savings and loan accounts regarding current balance, checking history, savings dividends and rates, loan interest and payoff amounts, payroll and automatic deductions.
    3. Make transfers to or from Prime Share, Deposit, Transaction, Checking, or other Savings or such accounts you have authorized in writing prior to such transfer request.
    4. Request advances on your personal line of credit loan, deposit the proceeds in any of your accounts or have the proceeds mailed directly to you at the mailing address listed for your account.
    5. Withdraw funds from savings, checking and line of credit accounts by check made payable to you and mailed to you at your mailing address.
    6. Make loan payments from any savings or checking account to any loan account of yours.


  6. Preauthorized Debit Transactions. Credit Union will process automatic withdrawals from your checking account funds if you preauthorize and individual or entity to receive such withdrawals. There are no limitations on frequency and dollar amount of preauthorized checking account withdrawals.

  7. Direct Deposit. Upon instruction from:
    1. your employer;
    2. the U.S. Treasury Department or;
    3. other financial institutions, the Credit Union will accept direct deposits of your paycheck or recurrent Federal payments (i.e. Social Security, etc.).
  8. Automatic Payment/Deposit (ACH). You may authorize the Credit Union to transfer monthly funds from another financial institution to your Forest Park FCU account. The automatic transfer will be made on the date you select, or the following business day, if that date falls on a weekend or holiday.

  9. Member Services. Telephone services are provided by our Member Services staff during business hours. Verification of account ownership will be requested before account information is released. To ensure courteous and efficient service, supervisory personnel in our Member Service Department may monitor calls randomly.

  10. Electronic Check Transactions. You authorize us to honor any electronic check conversion transaction and re-present check fee debit transactions (electronic check transactions). You agree that your authorization for an electronic check transaction occurs when you initiate such a transaction after receiving any notice regarding the merchant¹s right to process the transaction. Notice may include a sign posted by the merchant at the time and place of your transaction. All terms governing electronic check transactions, except the $50 and $500 limits of liability for unauthorized transactions in Section E Member Liability. You remain responsible for notifying us of any unauthorized electronic check transaction shown on your statement.



B. Service Limitations

  1. Transfer Limitations. For share savings and money market accounts, if applicable, you may make up to six (6) preauthorized, automatic, telephonic, or audio response transfers to another account of your or to a third party during any statement period.  A preauthorized transfer includes any arrangement with the Credit Union to pay a third party from the member¹s account upon oral or written orders including orders received through the Automated Clearing House (ACH). There is no limit on the number of transactions you may make in the following manner:
    1. Transfers to any loan account with the Credit Union;
    2. Transfers to another Credit Union account or withdrawals (checks mailed directly to you) when such transfer or withdrawal is initiated in person, by mail, or at an ATM.
    If a transfer request would exceed the transfer limitations set forth above in any statement period, the Credit Union may refuse or reverse the transfer, and your account will be subject to suspension or closure by the Credit Union, and the Credit Union may impose a charge.

  2. Card Acceptance. We do not promise everyone will honor your Card, and we have no obligation to you if anyone refuses to accept your Card. We are not liable if any merchant, bank, financial institution or other party refuses to honor your Card, or otherwise fails to provide any services made available to you by the Credit Union.

  3. POS/Debit/VISA Check Card Purchases. You may purchase up to $500 of goods and services at POS terminals each day. This limit is in addition to any ATM withdrawals, the combined total of which may not exceed $750. There is a limit of 20 transactions totaling no more than $2000 on the number and amount of debit card purchase transactions you may make each day. No purchase may exceed the available funds in your account. The Credit Union reserves the right to refuse any transaction which would draw upon insufficient funds or require us to increase our required reserve on the account. The Credit Union may set other limits on the amount of any transaction, and you will be notified of those limits.

  4. ATM Transactions.
    1. Withdrawals. You may withdraw up to $500 in any 24-hour period (if sufficient funds exist in your account). The amount you may withdraw decreases to $200 per day in the event the authorizing network is off-line)
    2. Deposits. Because of the servicing schedule and processing time required in ATM operations, there is a delay between the time a deposit (either cash or check) is made and when it will be available for withdrawal. You should review the Credit Union¹s Funds Availability Policy to determine the availability of funds deposited to ATMs.
    3. Transfers. You may transfer up to the balance in your accounts at the time of the transfer.


  5. TeleTouch 24 Service. Your accounts can be accessed under audio response via a touch tone telephone only. Not all push0button telephones are touch-tone. Converters may be purchased for pulse and rotary dial telephones. Audio response service will be available for your convenience seven (7) days per week. This service may be interrupted for a short time each day for data processing. There is no limit to the number of inquiries, transfers, or withdrawal requests you may make in any one day, however, there are certain limitations on transfers from savings accounts, see Transfer Limitations in Section B (1). No transfer or withdrawal may exceed the available funds in your account. The Credit Union reserves the right to refuse any transaction which would draw upon insufficient funds, exceed a credit limit, lower an account below a required balance, or otherwise require us to increase our required reserve on the account. Transactions made after the close of normal business hours each day will be posted to your account on the next business day after the date of the transaction. All checks are payable to you as a primary member and will be mailed to your address of record. The Credit Union may set other limits on the amount of any transaction, and you will be notified of those limits. The Credit Union may refuse to honor any transaction for which you do not have sufficient available verified funds. There is no limit on the number of transaction requests you may make during a single telephone call however there are certain limitations on transfers from savings accounts, see Transfer Limitations in Section B (1). The system will discontinue if no transaction is entered. If you wish to make any further transactions, you will have to call back. The system will also discontinue after three (3) unsuccessful attempts to enter a transaction.

  6. eBranch (PC Banking thru Internet Connection) You may make eBranch transactions at any time seven (7) days per week. There may be some down time. You may make fund transfers to your accounts or other accounts you authorize as often as you like, however, there are certain limitations on transfers from savings accounts, see Transfer Limitations in Section B (1). You may transfer up to the balance in your accounts at the time of the transfer, except as limited under other agreements. The Credit Union reserves the right to refuse any transaction that would draw upon insufficient funds, lower an account below a required balance, or otherwise require us to increase our required reserve on the account. In addition, our Funds Availability Policy may limit the availability of funds transferred by eBranch. Account balance and transaction history information may not show all account activity involving your accounts.

  7. E-Mail. The Credit Union may not immediately receive e-mail communications that you send and the Credit Union will not take action based on e-mail requests until the Credit Union actually receives your message and has a reasonable opportunity to act. We reserve the right to require any stop payment notices to be put in writing and we may refuse to send certain information through unsecured e-mail communications. If you need to contact the Credit Union immediately regarding an unauthorized transaction or stop payment request, you may call the Credit Union at the telephone number in Section E or on the back of this disclosure.



C. Data Security for eBranch
eBranch is accessible only over the Internet. To prevent unauthorized access to member account data, the Credit Union employs the Secure Sockets Layer (SSL) protocol. This prevents other computers from eavesdropping by encrypting all data transmitted between the eBranch server and the client. Members that live in the United States can use browsers that support 128 bit keys. Cracking a 128-bit key would involve trying all 2128 combinations. Members that live abroad are currently restricted by the US Government to using browsers that support 40 bit keys. Cracking a 40-bit key would involve trying all 240 combinations, which are over one trillion combinations. A 40-bit key is less secure than a 128-bit key, but does provide an adequate level of security for member financial services.

The Secure Sockets Layer protocol validates the identity of the eBranch server through the use of a digital certificate. After connecting to the eBranch server in secure mode, our site sends a signed digital certificate, which contains the name of our Web server, its public encryption key, the certificate¹s validity dates, the name of the certification authority that issued the digital certificate to our site, and an unforgeable digital signature. The digital certificate authenticates to the client that a connection has indeed been established with the eBranch server.

The Secure Sockets Layer ensures that the data transmitted between the client and the eBranch server has not been tampered with through the use of Message Authentication Codes (MACs). A MAC is based on the actual data itself, similar to a checksum. This provides a quick way for the receiving end to verify that the data was not changed enroute.

The eBranch server requires the use of a browser that supports SSL and Cookies.

D. Security of PIN/Access Codes
The ATM PIN, TeleTouch 24 PIN and eBranch PIN are issued to you for your security purposes. The access codes are confidential and should not be disclosed to third parties or recorded on or with your Card. You are responsible for safekeeping your access codes. You agree not to disclose or otherwise make your access codes available to anyone not authorized to sign on your accounts. If you authorize anyone to use your access codes, that authority shall continue until you specifically revoke such authority by notifying the Credit Union. If you fail to maintain the security of these access codes and the Credit Union suffers a loss, we may terminate your ATM and account services immediately.

E. Member Liability
You are responsible for all transfers you authorize using an EFT service under this Agreement. If you permit other persons to use an EFT service or your PIN or access code, you are responsible for any transactions they authorize or conduct on any of your accounts.

Tell us at once if you believe your Card or an Access Code has been lost or stolen. Telephoning is the best way of keeping your possible losses down.

For VISA/VISA Check Card transactions, if you notify us of your lost or stolen card within two (2) business days of discovery, you may not be liable for any losses. If you notify us of your lost or stolen card after two (2) business days of your discovery, your maximum liability for losses to your account may be up to $50. These liability limits will apply, provided you were not grossly negligent or fraudulent in handling your VISA.VISA Check Card and you provide us with written statement regarding your unauthorized VISA/VISA Check Card claim.

For all other EFT transactions that require the use of a PIN or Access Code, if you tell us within two (2) business days, you can lose no more than $50 is someone uses your card and PIN or Access Code without your permission. If you do not tell us with two (2) business days after you learn of the loss or theft of your Card. PIN or Access Code, and we can prove that we could have prevented the unauthorized transaction if you had told us in time, you could lose as much as $500. In no event will you be liable for more than $50 for any unauthorized line of credit transaction.

Also, if your statement shows transfers that you did not make, tell us as once. If you do not tell us with sixty (60) days after the statement was mailed to you, you may not get back any money lost after the sixty (60) days if we can prove that we could have stopped someone from making the transfers if you had told us in time. If a good reason (such as a hospital stay) kept you from telling us, we will extend the time periods. If you believe that your Card or Access Code has been lost or stolen or that someone has transferred or may transfer money from your account without your permission, you must call:

F. Fees and Charges
There are certain charges for electronic fund transfer services as set forth on the Rate and Fee Schedule. From time to time, the charges may be changed. We will notify you of any changes as required by law.

G. Right to Receive Documentation of Transfers

  1. Periodic Statements. Transfers and withdrawals transacted through an ATM or POS terminal, Teletouch 24, eBranch or debit card purchase will be recorded on your periodic statement. You will receive a statement monthly unless there is no transaction in a particular month. In any case, you will receive a statement at least quarterly.

    The following comments will appear on the periodic statement of both the sender AND the receiver of funds: 1) The dollar amount of transferred funds; 2) The account number that funds were transferred from and into; 3) The names of the sender and receiver of the funds. No other account information will be exchanged.

  2. Direct Deposits. If you have arranged to have a direct deposit made to your account at least once every sixty (60) days from the same source and you do not receive a receipt (such as a pay stub), you can find out whether or not the deposit has been made by calling the telephone numbers listed in this Agreement. This does not apply to transactions occurring outside the United States.

  3. Terminal Receipt. You get a receipt at the time you make any transfer to or from you account at an ATM or POS terminal.



H. Account Information Disclosure

We will disclose information to third parties about your account or the transfers you make:

  1. As necessary to complete transfers;
  2. To verify the existence of sufficient funds to cover specific transactions upon the request of a third party, such as a credit bureau or merchant;
  3. To comply with government agency or court orders;
  4. If you give us your written permission.



I. Credit Union Liability for Failure to Make Transfers

If we do not complete a transfer to or from your account on time or in the correct amount according to our agreement with you, we will be liable for your losses or damages. However, there are some exceptions. We will not be liable for instance:

  1. If, through no fault of ours, you do not have enough money in your account to make the transfer or the transfer would go over the credit limit on your line of credit.
  2. If you used the wrong access code or you used an access code or Card in an incorrect manner.
  3. If the automated teller machine (ATM) where you are making the transfer does not have enough cash.
  4. If the ATM or POS terminal was not working properly and you knew about the problem when you started the transaction.
  5. If circumstances beyond our control (such as fire, flood or power failure) prevent the transaction.
  6. If the money in your account is subject to legal process or other claim.
  7. If your account is frozen because of a delinquent loan.
  8. If there are other exceptions as established by the Credit Union.
  9. The ATM machine may retain your Card in certain instances, in which event you may contact the Credit Union about its replacement.


J. Preauthorized Electronic Fund Transfers

  1. Stop Payment Rights. If you have arranged in advance to make regular electronic fund transfers out of your account(s) for money you owe others, you may stop payment of preauthorized transfers from your account. You must notify the Credit Union orally or in writing in time for us to receive you request three (3) business days or more before the scheduled date of the transfer. The Credit Union may require written confirmation of the stop payment order to be made within fourteen (14) days of any oral notification. If we do require the written confirmation, the oral stop payment order shall cease to be binding fourteen (14) days after it has been made.
  2. Notice of Varying Amounts. If these payments will vary in amount, you have the right to receive written notice of the amount of the transfer ten (10) days before the scheduled transfer date. You agree the Credit Union will not provide such notice, but such notice must be obtained from the payee. You may choose instead to get this notice only when the payment would differ by more than a certain amount from the previous payment or when the amount would fall outside certain limits set by you.
  3. Liability for Failure to Stop Payment of Preauthorized Transfers If you order us to stop one of these payments three (3) business days or more before the transfer is scheduled, and we do not do so, we will be liable for your losses or damages if you gave us the correct information.



K. Termination of EFT Services
The Credit Union reserves the right at any time to terminate your right to make transactions and to retrieve or ask for the immediate return of any ATM Card it deems necessary without prior notice to you. The ATM Card at all times remains the property of the Credit Union. Upon termination of this Agreement and Disclosure, you agree to surrender your ATM Card to the Credit Union, if the Card is lost or stolen, you agree to notify the Credit Union immediately upon discovery of such loss or theft. The Credit Union may terminate your rights without prior notice to you in the event that any of the following conditions occur:

  1. You, or any authorized user of your Card or access code, breach this or any other agreement with us;
  2. We have reason to believe that there has been an unauthorized use of your accounts or access codes;
  3. We notify you or any other party to your account that we have canceled or will cancel this Agreement;
  4. Three or more overdrafts occur as a result of nonsufficient or uncollected funds on an account;
  5. Any transaction that occurs (on your accounts) which results in a monetary loss to the Credit Union;
  6. Loan, VISA or other delinquency with the Credit Union;
  7. Forced closure of any of your accounts at the Credit Union due to misuse; or
  8. Any other situation in which the Credit Union deems revocation to be in its best interest.



The Credit Union reserves the right to amend, modify, revoke, or cancel the terms of this Agreement and Disclosure or any transaction services contemplated herein. If notification is required by law, notice will be mailed to you at the address shown on the Credit Union¹s records. It is the obligation of each member to update any new address. Any revised, amended, or modified conditions, rules, regulations shall be effective at the earliest date allowed by law.

You or any other party to your account can terminate this Agreement and Disclosure by notifying the Credit Union in writing. Termination of service will be effective the first business day following receipt of your written notice. Termination of this Agreement and Disclosure will not affect the rights and responsibilities of the parties under this Agreement and Disclosure for transactions initiated before termination.

L. Notices
The Credit Union reserves the right to change the terms and conditions upon which this service is offered. The Credit Union will mail notice to you at least twenty-one (21) days before the effective date of any change, as required by law. Use of this service is subject to existing regulati0ons governing the Credit Union account and any future changes to those regulations.

M. Billings Errors
In case of errors or questions about your electronic transfers, telephone us at the telephone numbers or write us at the address listed in either section E. Membership Liability, or at the end of this disclosure, as soon as you can. (For any errors involving a line of credit account, you must review your Loan Agreement and Disclosure and/or VISA Credit Card Agreement for a description of your rights.) We must hear from you no later than sixty (60) days after we sent the first statement on which the problem appears. You should provide the following information:

  1. Tell us your name and account number.
  2. Describe the transfer you are unsure about, and include to the extent possible, the type, date and explain as clearly as you can why you believe it is an error or why you need more information.
  3. Tell us the dollar amount of the suspected error.



If you tell us orally, we may require that you send us your complaint or question in writing within ten (10) business days, at the address listed in this Agreement and Disclosure.

We will tell you the results of our investigation within ten (10) business days after we hear from you and will correct the error within one business day after determining that an error occurred.

If we need more time, however, we may take up to forty-five (45) days to investigate your complaint or question. If we decide to do this, we will recredit your account with ten (10) business days of receiving the error notice, and will inform you, with two (2) business days, after providing the provisional credit, with the amount you think is in error, and the date, so that you will have the use of the money during the time it takes us to complete our investigation. We will correct the error, if any, within one business day after determining that an error occurred. A report of our results will be delivered or mailed to you within three (3) business days after the conclusion of the investigation ) including, if applicable, notice that a provisional credit has been made final).

For transactions initiated outside the United States, or resulting from a point-of-sale debit card transaction, we will have ninety (90) calendar days instead of forty-five (45) business days, unless otherwise required by law, to investigate your complaint or question. For transactions on accounts that have been open less than thirty (30) calendar days, we will have twenty (20) business days instead of ten (10) business days to credit your account, and ninety (90) calendar days instead of forty-five (45) business days, unless otherwise required by law, to investigate your complaint or question.

If we determine that no error occurred or an error occurred in a manner or amount different from that described by the member, the results of our investigation are available, and at your request will be delivered or mailed along with documents that we relied upon in making this determination (to the extent possible without violation of other members; rights to privacy). We will notify you of the date and amount we will debit your account. Further, we will honor drafts, or similar instruments payable to third parties and preauthorized transfers from your account (without charge, as a result of an overdraft) for five (5) business days after the notification. We will only honor items that would have been paid if the provisionally credit funds had not been debited.

N. ATM Safety Notice
The network of Automated Teller Machines (ATMs) offers you the convenience of 24-hour access to your money. Every effort has been made to provide you with safe, well-lighted locations. The following safety guidelines are a reminder of things you can do to help us protect you and your ATM Card"

  1. Be aware of your surroundings, particularly at night. Consider having someone accompany you when the ATM machine is used after dark.
  2. If another person is uncomfortably close to you at the time of your transaction, ask the person to step back before you complete your transaction.
  3. Refrain from displaying your cash at the ATM machine. As soon as your transaction is completed, place your money in your purse or wallet. Count the cash later in the safety of your car or home.
  4. If you notice anything suspicious at the ATM machine, consider using another ATM machine or coming back later. If you are in the middle of a transaction and you notice something suspicious, cancel the transaction, take your ATM access device or deposit envelope, and leave.
  5. If you are followed after making a transaction, go to the nearest public area where people are located.
  6. Do not write your personal identification number or code on your ATM card.
  7. Report all crimes to law enforcement officials immediately.

Although the number of ATM crimes is very low, we urge all our members to follow these simple safety rules for the protection of you and your Card while you continue to enjoy the convenience of Automated Teller Machines.

O. Indemnity
If you ask the Credit Union to follow instructions that the Credit Union believes might expose it to claims, lawsuits, expenses, liabilities, or damages, whether directly or indirectly, the Credit Union may refuse to follow your instructions or may require a bond or other protection. An example of the kind of protection asked for would be your promise to defend the Credit Union against any claims and pay all legal fees and costs associated with the defense.

P. Waiver
Any waiver of any term or condition stated in this Agreement must be in writing and signed by an officer of the Credit Union and shall not be considered as a waiver of any future or other obligation or right.

Q. Severability
In the event that any paragraph of this Agreement or any portion thereof is held by a court to be invalid or unenforceable for any reason, the other paragraphs and portions of this Agreement shall not be invalid or unenforceable and will continue in full force and effect. All headings are intended for reference only and are not to be construed as part of the Agreement.

R. Governing Law
This Agreement is governed by the Bylaws of the Credit Union, federal laws and regulations, the laws and regulations of the state of Oregon, and local clearinghouse rules, as amended from time to time. To the extent permitted by applicable law, you agree that any legal action regarding this Agreement shall be brought in Multnomah County, where the Credit Union is located.

S. Enforcement
You agree to be liable to the Credit Union for any liability, loss, or expenses as provided in this Agreement that the Credit Union incurs as a result of any dispute involving your accounts or services. You authorize the Credit Union to deduct any such liability, loss, or expenses from your account without prior notice to you. In the event the Credit Union brings a legal action to enforce the Agreement or collect any amount due under this Agreement, the Credit Union shall be entitled, subject to applicable law, to payment of its reasonable attorney¹s fees and costs, including fees on any appeal, bankruptcy proceedings, and any post-judgment collection actions.
